USER AGREEMENT

Welcome to a website operated by Montanans Securing Reproductive Rights (“MSRR Site”). In addition to the site, this User Agreement may also apply and govern your use of any mobile application, online service, or platform operated by MSRR that link to this User Agreement.

This User Agreement also does not apply to websites that MSRR does not operate where MSRR has a presence, such as the MSRR page on Facebook.

Finally, this is not the User Agreement for the websites of any MSRR local/state/territory supporter organizations (“Supporters”). In all those cases, site-specific terms of use apply, and you should refer to the relevant website for applicable terms of use.

Please read this User Agreement carefully, including the MSRR Privacy Policy.

Compliance with Laws.

You agree to comply with all applicable laws regarding your use of the MSRR Site. You further agree
that information provided by you is truthful and accurate to the best of your knowledge.

Intellectual Property

Except where otherwise indicated, MSRR maintains sufficient rights, title and interest in and to all intellectual property related to this website, including relevant copyright rights in all the materials on the MSRR Site, including text, graphics, logos, button icons, audio clips, video clips, photographs, and software ( collectively, “MSRR Content”). You may not copy, distribute, display or make any other use, including derivative works, of any MSRR Content without the prior written consent of MSRR. All rights to MSRR Content are reserved to MSRR.

Copyrights and Copyright Agent

If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent:

(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

(b) A description of the copyrighted work that you claim has been infringed;

(d) Your address, telephone number, and e-mail address;

(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

(f) A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Intended Audience.

This website is intended for adults only. This website is not intended for any children under the age of 13.

Links to Other Websites

The MSRR Site may contain links to other websites, applications (mobile or otherwise) or other content that we think may be of interest to you (collectively “Third Party Content”). We are not responsible for and have no control over Third Party Content and you should read any applicable use or intellectual property limitations. Remember that when you link to another site, that other site is governed by its own user agreement and privacy statement, which you should be sure to read.

Disclaimers and Limitation of Liability

ALTHOUGH WE TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES, WORMS, “TROJAN HORSES,” OR OTHER DESTRUCTIVE MATERIALS TO THE MSRR SITE, WE DO NOT GUARANTEE OR WARRANT THAT THE MSRR SITE OR MATERIALS THAT MAY BE DOWNLOADED FROM THE MSRR SITE ARE FREE FROM SUCH DESTRUCTIVE FEATURES. WE ARE NOT LIABLE FOR ANY DAMAGES OR HARM ATTRIBUTABLE TO SUCH FEATURES.

THE INFORMATION ON THE MSRR SITE IS PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. MSRR DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.

WE ARE NOT LIABLE FOR ANY CLAIM, LOSS, OR INJURY BASED ON ERRORS, OMISSIONS, INTERRUPTIONS. OR OTHER INACCURACIES IN THE MSRR SITE, NOR FOR ANY CLAIM, LOSS. OR INJURY THAT RESULTS FROM YOUR USE OF THE MSRR SITE OR YOUR BREACH OF ANY PROVISION OF THIS USER AGREEMENT.

Termination

We reserve the right to terminate the MSRR Site and this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Limitation of Liability and Governing Law Sections of this User Agreement survive any such termination.

Governing Law

This User Agreement is governed by the laws of the State of Montana applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts in the State and County of Montana and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Modifications

We reserve the right to amend or otherwise modify the MSRR Site, the User Agreement and the Privacy Policy at any time. You should review this User Agreement upon each and every use or access to the MSRR Site. Your continued use or access to the MSRR Site shall constitute your acceptance of the amended or modified MSRR Site, User Agreement or the Privacy Policy.
